Welcome to Moksha Wellness. These Terms & Conditions ("Terms") govern your use of the Moksha Wellness website and your purchase, booking, access to, or participation in services, memberships, digital content, events, retreats, and other offerings provided by Moksha Wellness.
Moksha Wellness operates through Moksha Wellness LLC in the United States and Sarah Savidge Holdings (Pty) Ltd, trading as Moksha Wellness, in South Africa. The entity providing your particular service may depend on the nature and location of the offering.
By accessing this website, making a purchase, booking a service, subscribing to an online offering, or participating in a Moksha Wellness experience, you agree to these Terms and any additional terms, waivers, participant agreements, or policies applicable to the specific offering. If you do not agree to these Terms, please do not purchase, book, access, or participate in our offerings.
Moksha Wellness provides wellness-related services and experiences that may include:

You must be at least 18 years old to independently purchase or participate in Moksha Wellness services unless we have expressly agreed otherwise and appropriate consent from a parent or legal guardian has been obtained.
By booking or purchasing a service, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms.
Moksha Wellness provides wellness and educational services. Yoga, sound healing, breathwork, meditation, somatic practices, and related offerings are not medical treatment, psychological treatment, psychotherapy, physiotherapy, or a substitute for professional medical or mental-health care.
Nothing provided through Moksha Wellness should be interpreted as medical advice, diagnosis, treatment, or a recommendation to discontinue or replace care from a qualified healthcare professional.
You are responsible for consulting an appropriate medical or healthcare professional regarding any questions or concerns about your health and your ability to safely participate.
If you are pregnant, injured, recovering from surgery, living with a medical or mental-health condition, taking medication that may affect your participation, or have any other health concern that could affect your ability to safely participate, you should obtain appropriate professional advice or clearance before participating.
Participation in physical and wellness activities involves inherent risks.
By participating in a Moksha Wellness service or experience, you acknowledge that it is your responsibility to determine whether you are physically and otherwise able to participate safely.

Moksha Wellness may modify an activity, recommend that you do not participate in a particular practice, or refuse or discontinue a service where we reasonably believe participation may be unsafe.
Certain services may require completion of an intake form, health questionnaire, waiver, participant agreement, or consent form before participation.
These may be administered through Moksha Wellness or a third-party booking platform such as Bookamat.
Completion of required documentation may be a condition of participation.
These Terms do not replace any separate waiver, consent form, retreat agreement, or participant agreement you may be required to accept. Where additional terms apply to a particular service or event, those terms form part of your agreement with Moksha Wellness.
Private yoga, sound healing, breathwork, meditation, and other private services may be arranged directly with Moksha Wellness through email, WhatsApp, or another designated booking method.
Unless otherwise agreed in writing, payment is required in full to secure your private session.
Your booking is not considered confirmed until any required payment has been received and confirmation has been provided by Moksha Wellness.
Moksha Wellness maintains a 24-hour cancellation policy for private sessions.
If you cancel a private session with less than 24 hours' notice, the full session fee will be charged and is non-refundable.
We understand that unexpected circumstances occur and will make reasonable efforts to reschedule a late-cancelled session where possible. However, rescheduling is not guaranteed. If the session cannot reasonably be rescheduled, the full session fee will remain payable.
This policy reflects the time reserved exclusively for your appointment and the limited ability to offer that time to another client at short notice.
For private-session rescheduling requests, please contact Sarah directly through the designated Moksha Wellness WhatsApp contact.
Occasionally, Moksha Wellness may need to cancel or reschedule a private session due to illness, emergency, safety concerns, circumstances outside our reasonable control, or other unforeseen events.
Where Moksha Wellness cancels a private session, we will make reasonable efforts to offer an alternative date or time.
If Moksha Wellness is unable to provide the purchased private session within a reasonable period, amounts paid for the affected session may be credited or refunded as appropriate, subject to applicable law.
Prices may be charged in South African Rand (ZAR) or United States Dollars (USD) depending on the service, location, event, and applicable Moksha Wellness entity.
Payments may be accepted through methods including:
You agree to provide accurate billing and payment information and authorize the applicable payment provider to process the amounts associated with your purchase.
Unless expressly stated otherwise, payment is required in full when booking or purchasing a service.
Any applicable payment-processing, currency-conversion, international banking, or similar charges imposed by your financial institution or payment provider are your responsibility unless otherwise required by law.
Except where expressly stated otherwise for a particular offering or required by applicable law, payments made to Moksha Wellness are non-refundable.
Failure to attend, use, access, or complete a purchased service does not automatically entitle you to a refund.
Any exception to this policy must be confirmed by Moksha Wellness in writing.
Nothing in these Terms excludes refund, cancellation, or other consumer rights that cannot lawfully be excluded under applicable law.
Moksha Wellness offers an online wellness studio through Thrive or another designated platform.
Membership may be offered on a monthly or annual subscription basis. Applicable pricing and billing frequency will be displayed when you subscribe.
By purchasing a subscription, you authorize the applicable payment processor to charge the subscription fee according to the billing frequency selected until you cancel your membership.
Unless otherwise stated at the time of purchase, monthly and annual subscriptions may automatically renew at the end of each applicable billing period until cancelled.
You are responsible for cancelling your membership before the next renewal date if you do not wish to incur the next subscription charge.
Moksha Wellness is not responsible for your failure to cancel before a renewal is processed, except where applicable law provides otherwise.
You may cancel your online membership at any time.
Cancellation prevents future renewal charges but does not result in a refund for amounts already paid.
Following cancellation, you may continue accessing the online studio until the end of your current paid subscription period. Access will terminate when that period expires.
There are no prorated refunds or credits for unused portions of a subscription unless required by applicable law.
Your online membership is for your individual, personal use only.
You may not share your username, password, account, subscription, or access credentials with another person.
You are responsible for maintaining the confidentiality and security of your login information.
We reserve the right to suspend or terminate access if we reasonably believe an account is being shared, misused, copied, redistributed, or accessed in violation of these Terms.
The health and safety provisions contained in these Terms also apply to online classes and recorded wellness content.
Because Sarah or another Moksha Wellness practitioner may not be physically present to observe you during an online or recorded session, you are responsible for:
You participate in online and recorded practices at your own discretion and responsibility, subject to rights that cannot lawfully be excluded.
Moksha Wellness may offer events, workshops, private wellness experiences, immersions, day retreats, multi-day retreats, and international retreats.
Pricing, payment schedules, currencies, deposits, inclusions, exclusions, cancellation policies, and participation requirements may vary between events.
Specific booking terms will be communicated for the applicable event or retreat.

You are responsible for reviewing all applicable terms before completing your booking.
Where a deposit is required to reserve your place at an event or retreat, the deposit is non-refundable unless expressly stated otherwise or required by law.
Some events may require payment in full at the time of booking.
The payment schedule applicable to your event or retreat will be communicated before or at the time of booking.
Failure to make a required payment by the applicable deadline may result in cancellation of your reservation and forfeiture of amounts already paid, subject to the specific event terms and applicable law.
Cancellation and refund policies may vary depending on the event or retreat.
Unless the specific event terms expressly provide otherwise, event and retreat payments are generally non-refundable.
We strongly encourage participants to carefully review the applicable cancellation policy before booking and to obtain appropriate travel insurance for retreats involving travel.
Moksha Wellness reserves the right to reasonably modify, postpone, relocate, or cancel an event or retreat due to circumstances including insufficient participation, practitioner illness, venue issues, travel disruption, safety concerns, government restrictions, force majeure events, or other circumstances beyond our reasonable control.
If Moksha Wellness cancels or postpones an event, amounts collected may, depending on the circumstances and applicable event terms, be:

Except where required by applicable law or expressly agreed in writing, Moksha Wellness is not responsible for separate costs incurred by participants in connection with an event, such as flights, accommodation, visas, transportation, insurance, or other travel arrangements.
Unless expressly included in the applicable retreat or event package, participants are responsible for arranging and paying for their own:
You are responsible for ensuring that your travel documents and arrangements are valid and appropriate for your destination.
Where applicable, we strongly recommend comprehensive travel insurance covering cancellation, interruption, illness, injury, lost luggage, and other reasonably foreseeable travel risks.
Unless otherwise stated, the Moksha Wellness website and its original content are owned by or licensed to Moksha Wellness and are protected by applicable copyright, trademark, and intellectual-property laws.
This includes, where applicable:
Third-party photographs, music, video, fonts, or other materials remain the property of their respective owners and are used under applicable licenses or permissions.
When you purchase or access digital Moksha Wellness content, you receive a limited, revocable, non-exclusive, non-transferable license to use that content for your own personal, non-commercial purposes.
Purchasing or accessing content does not transfer ownership or intellectual-property rights to you.

While we select service providers reasonably suited to our business needs, we do not control third-party systems and cannot guarantee that they will always operate without interruption, error, or security incidents.
Wellness is highly individual.
Moksha Wellness does not guarantee that participation in yoga, sound healing, breathwork, meditation, retreats, online classes, or other offerings will produce any particular physical, emotional, mental, therapeutic, or wellness result.
Testimonials, client experiences, and descriptions of potential benefits represent individual experiences or general information and should not be interpreted as guarantees.
To the fullest extent permitted by applicable law, Moksha Wellness and its owners, practitioners, employees, contractors, facilitators, and representatives will not be liable for indirect, incidental, consequential, special, or punitive losses arising from your use of the website, digital content, or participation in Moksha Wellness offerings.
Nothing in these Terms is intended to exclude or limit liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection laws.
Your statutory rights remain unaffected.
You acknowledge that yoga, movement, breathwork, sound-based practices, retreats, travel, and other wellness activities may involve inherent risks.
By voluntarily participating, you acknowledge and accept the ordinary and reasonably foreseeable risks associated with the activity, subject to applicable law and any separate waiver or participant agreement.
You remain responsible for communicating relevant health information and making reasonable decisions regarding your own participation.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Moksha Wellness and its owners, practitioners, employees, contractors, and representatives from third-party claims, liabilities, losses, or expenses arising directly from your unlawful conduct, material breach of these Terms, or infringement of another party's rights.
This provision does not require you to indemnify Moksha Wellness for liability that cannot lawfully be transferred or excluded.
Moksha Wellness will not be responsible for failure or delay in performing obligations where performance is prevented or materially affected by circumstances beyond our reasonable control.
These circumstances may include natural disasters, extreme weather, fire, epidemic or pandemic, governmental restrictions, civil unrest, strikes, transportation disruption, venue closure, utility or technology failures, or other comparable events.
Where such circumstances affect a booking, event, or retreat, Moksha Wellness will make reasonable efforts to communicate available options.
Your use of the Moksha Wellness website and services is also subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information.
Where you provide health or other sensitive information, additional consent, intake, or privacy provisions may apply.
Because Moksha Wellness operates internationally, the law applicable to a transaction or service may depend on the entity providing the service, the location of the offering, and mandatory laws applicable to the client.
For services and events provided in South Africa by Sarah Savidge Holdings (Pty) Ltd, trading as Moksha Wellness, these Terms are generally governed by the laws of the Republic of South Africa, subject to any mandatory consumer rights or other laws that apply.
Services provided through Moksha Wellness LLC or international offerings may be subject to the governing-law provisions stated in the applicable booking, subscription, retreat, or participant agreement.
Nothing in these Terms deprives a consumer of mandatory rights or protections that cannot lawfully be waived under applicable law.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.
If Moksha Wellness does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.
